The Secretary of State for Transport hereby makes this Scheme in exercise of powers conferred by sections 16, 17 and 19 of the Highways Act 1980[1], and now vested in him[2], and of all other enabling powers: 1. The M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984[3] (hereinafter referred to as"the principal scheme") is hereby varied so that (a) in article 5(2)(i), after the words"lettered C2" there are inserted the words"and the plan folio numbered HA16/1 WMRO XIX marked"The M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984 Variation (No. 2) Scheme 1988, containing a map with the reference D2"" and for the word"each" there is substituted the word"all"; (b) for paragraph 5 of Schedule 2 there is substituted the following paragraph: "5. Junction with the A41 Trunk Road at Barford, Warwick Two routes to connect the northbound and southbound carriageways of the motorway with a roundabout proposed to be constructed as part of the A41 Trunk Road at Barford (the special roads along those routes being respectively given the reference letters M and N on the map given the reference D2 in the deposited plan)".
2. For the purposes of article 3 of the principal scheme (date on which special roads are to become trunk roads), in relation to the special roads described in paragraph 5 of Schedule 2 to that order as substituted by article 1(b) of this Scheme the date be the date when this Scheme comes into force. 3. The connecting roads lettered M and N on the map with the reference D in the plan folio numbered HA16/1 WMRO(L)I marked"The M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984" shall be deemed to be omitted from that folio. 4. This Scheme shall come into force on 28th January 1988 and may be cited as the M40 London-Oxford-Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No. 1) Scheme 1984 Variation (No. 2) Scheme 1988.
