The Local Government (Compensation for Premature Retirement) (Scotland) Amendment Regulations 1990

    The Secretary of State, in exercise of the powers conferred upon him by section 24 of the Superannuation Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:
    Citation and commencement
        1.—(1)  These Regulations may be cited as the Local Government (Compensation for Premature Retirement) (Scotland) Amendment Regulations 1990.

        (2)  These Regulations shall come into force on 27th February 1990 and shall have effect from 25th September 1989.
    Interpretation
        2.    In these Regulations, "the principal Regulations" means the Local Government (Compensation for Premature Retirement) (Scotland) Regulations 1979[2].
    Amendment of the principal Regulations
        3.    In Schedule 1 to the principal Regulations-
       (a) at the end of paragraph (h) the full stop shall be replaced by a semi-colon; and
       (b) after paragraph (h) there shall be added the following paragraph:-
          "(i) the governors of Newbattle Abbey College.".

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations, by extending the application of the Local Government (Compensation for Premature Retirement) (Scotland) Regulations 1979, allow for the payment of compensation to, or in respect of, persons aged 50 or over who are members of the Local Government Superannuation Scheme, and employed at Newbattle Abbey College. Compensation is payable to such persons in terms of the principal Regulations, as amended by these Regulations, where such persons are prematurely retired by their employing authority on redundancy or in the interests of the efficiency of their employing authority's functions. The compensation is in the form of additions to accrued superannuation benefits.
    The Regulations have retrospective effect from 25th September 1989, as authorised by section 24(3)(c) of the Superannuation Act 1972.
