The Secretary of State for the Environment, Transport and the Regions makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf: - 1.This Order may be cited as the A5 Trunk Road (Churchbridge Improvement) Order 1998 and shall come into force on 12th February 1998. 2.In this Order -

(ii) "the plan" means the plan numbered HA 10/PS/194 marked ""The A5 Trunk Road (Churchbridge Improvement), signed by authority of the Secretary of State for the Environment, Transport and the Regions and deposited at the Highways Agency, Project Services, Room 12/27, St. Christopher House, Southwark Street, London SE1 0TE. 3.The main new road shall become a trunk road from the date when this Order comes into force.
(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for traffic. The route of the main new road is about 470 metres long from a point on the A5 Trunk Road about 250 metres southeast from the centre of its eastern junction with the A34 Trunk Road proceeding northwest to a point offset about 50 metres northeast of the existing A5 Trunk Road where it forms a new roundabout then generally northwards for about 135 metres where it forms a new roundabout then generally westwards for about 250 metres and finishing at a point on the western junction of the A5 and A34 Trunk Roads, all at Churchbridge in the County of Staffordshire.
