The Secretary of State for Environment, Food and Rural Affairs makes the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972[1]. She has been designated[2] for the purposes of that section in relation to the common agricultural policy of the European Community. Title, commencement and application 1.These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Reductions from Payments) (England) Regulations 2006, come into force on 26th February 2006 and apply in England only. Interpretation 2.In these Regulations—
Deductions from payments
(b) the aid schemes established in Chapters 1 to 7 of Title IV of the Council Regulation.
(This note is not part of the Regulations) These Regulations, which apply in England only, are made in accordance with Article 3 of Commission Regulation (EC) No 1954/2005 (O.J. No L 314, 30.11.2005, p. 10) ("the Commission Regulation"). They disapply Article 1 of the Commission Regulation with regard to payments to be made in respect of the year 2005 under the Single Payment Scheme and various other aid schemes established in Council Regulation (EC) No 1782/2003 (O.J. No L 270, 21.10.2003, p. 1). The effect of this is that payments under these schemes in respect of the year 2005 are to be made in accordance with Commission Regulation (EC) No 796/2004 (O.J. No L 141, 30.4.2004, p. 18) as if it had not been amended by Article 1 of the Commission Regulation.
